The U.S. Federal District Court (Central District of California) has now issued its Final Order (3/12) in the closely watched case of
F.T.C. vs. Burnlounge, Inc., et.al. The case is one of only a handful of pyramid cases in recent decades that was contested through a full trial in federal court. As with other pyramid cases, the principal concerns of the regulators and the Court were the Company’s heavy emphasis on recruiting and sales to participants rather than to non-participant customers, and the widespread use of exaggerated income claims in promoting the opportunity. The FTC charged Burnlounge, its CEO, and three of the company’s top independent sales reps with operating an illegal pyramid scheme and with making deceptive earnings claims in violation of Section 5 of the Federal Trade Commission Act.  The personal purchase of higher-priced packages provided participants with immediate higher award levels and eligibility for increased rates of commissions under the compensation plan. The Court’s initial decision and opinion, published in July 2011, found the defendants guilty of the charges. Among other things, the Court cited evidence that while the Company’s total sales approximated $28 million, only $1 million was derived from music sales to the company’s 50,000 non-participant customers. On the other hand, nearly $27 million represented personal purchases by more than 60,000 participants. During it’s nearly 2 years of operation, the Company paid out about $17 million to the participants in commissions and bonuses. They used the old Excel comp. plan just like FHTM does. Trouble lingers for all.
