has now issued its Final Order
(3/12) in the closely watched case
of
F.T.C.
vs. Burnlounge, Inc., et.al.
The case is one of only a handful
of pyramid cases in recent decades
that was contested through a full
trial in federal court. As with
other pyramid cases, the principal
concerns of the regulators and the
Court were the Company’s heavy
emphasis on recruiting and sales to
participants rather than to
non-participant customers, and the
widespread use of exaggerated
income claims in promoting the
opportunity. The FTC charged
Burnlounge, its CEO, and three of
the company’s top independent sales
reps with operating an illegal
pyramid scheme and with making
deceptive earnings claims in
violation of Section 5 of the
Federal Trade Commission Act.
